Terms of Service

These Terms of Service govern your use of the Hoadhaa Estate mobile app and services ("Hoadhaa", "we", "us"). Hoadhaa helps landlords and tenants in the Maldives list properties, apply for rentals, manage leases, track rent, and communicate. Please read them carefully.

1. Accepting these terms

By creating an account or using Hoadhaa, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the app.

2. Who can use Hoadhaa

You must be at least 18 years old and legally able to enter into a rental agreement under the laws of the Maldives.

If you use Hoadhaa on behalf of a company or another person (for example as a property manager), you confirm that you are authorised to act for them, and these Terms bind them as well as you.

3. Your account

You must give accurate, current information when you register and keep it up to date, including your name, contact details and identity documents.

You are responsible for keeping your password secure and for everything that happens under your account. Tell us immediately at support@hoadhaa.com if you think your account has been accessed without your permission.

Every account can act as both a tenant and a landlord, and you can switch between the two modes in the app. These Terms apply to you in whichever role you are using.

4. Hoadhaa is a platform, not a party

Hoadhaa provides tools that landlords and tenants use to deal with each other. We are not a landlord, tenant, real estate agent or broker, and we are not a party to any lease or rental agreement made through the app.

Landlords and tenants are solely responsible for their agreements, for checking each other's identity and suitability, and for complying with the laws that apply to their tenancy. Any dispute about a tenancy must be resolved between the landlord and the tenant.

5. Listings (landlords)

If you list a property, you confirm that you own it or are authorised to let it, and that the description, photos, rent, fees and availability you publish are accurate and not misleading.

Listings you publish, including their photos, location and the contact phone number shown on them, can be seen by anyone using the app. Listings marked private are not shown in Browse.

You must keep your listings up to date and remove or unlist a property that is no longer available. We may remove any listing that breaks these Terms.

6. Applications and agreements

When you apply for a property, the information and documents you submit are shared with that property's landlord and their authorised managers so they can review your application. You confirm that everything you submit is true and belongs to you.

A landlord may approve or reject an application at their own discretion. An approval is not a lease: the tenancy begins only once both parties have agreed the lease terms and the signed agreement has been uploaded.

The lease terms — including rent, deposit, advance rent, due date, notice period and any late fee — are set by the landlord and agreed between the landlord and tenant. Hoadhaa records and applies them as agreed but does not decide them.

7. Rent and payments

Hoadhaa does not collect, hold or transfer rent or deposits. Tenants pay landlords directly, by bank transfer to the account the landlord provides, or by other means the landlord accepts.

Tenants can upload a transfer slip as proof of payment. The landlord is responsible for checking it and confirming or rejecting the payment; a payment counts as received only once the landlord confirms it. Hoadhaa does not verify payments itself.

Rent charges, reminders, overdue status and late fees are generated automatically from the lease terms. Deposits, advance rent and refunds are handled between the landlord and tenant as set out in their agreement.

Hoadhaa does not charge tenants and does not take a commission on rent.

8. Landlord subscriptions

Some landlord features may require a paid subscription. Prices, trial periods and billing terms are shown before you subscribe and are billed separately from rent. If a subscription lapses or is suspended, some landlord features may be limited until it is renewed; your existing records are not deleted because of it.

9. Maintenance, messages and notices

Maintenance requests, messages, notices and the photos, videos and files attached to them are shared with the other people involved in the tenancy. Do not use them to send anything unlawful, abusive or unrelated to the tenancy.

Hoadhaa is not responsible for carrying out repairs or for the content of messages exchanged between users.

10. Acceptable use

You must not: give false information or impersonate anyone; upload forged documents or payment slips; list a property you are not authorised to let; harass, threaten or discriminate against other users; post unlawful, misleading or offensive content; collect other users' personal data for purposes unrelated to a tenancy; or try to interfere with, reverse engineer or gain unauthorised access to the app or its systems.

11. Your content

You keep ownership of the content you upload, such as photos, documents and messages. You give Hoadhaa a non-exclusive, royalty-free licence to store, process and display that content only as needed to run the service — for example, showing listing photos in Browse or sharing an application with a landlord.

You confirm that you have the right to upload the content and that it does not infringe anyone else's rights.

12. Suspension and termination

We may suspend or close an account, or remove content, if we reasonably believe it breaks these Terms, is fraudulent, or puts other users at risk.

You can delete your account at any time in the app, under Profile → Security → Delete account. Your account is deactivated straight away: you are signed out, your listings are hidden and pending applications are cancelled. If you sign in again within 30 days your account is restored. After 30 days it is permanently deleted.

You cannot delete your account while someone else still depends on it, for example while you have an active lease, unpaid rent, a payment waiting to be checked, or a deposit still owed. The app tells you what to resolve first.

Records of past leases and payments may be kept after deletion for the other party, as described in our Privacy Policy. If you cannot use the app, you can ask us to close your account by contacting support@hoadhaa.com.

13. Disclaimers

Hoadhaa is provided "as is" and "as available". We work to keep it accurate and running, but we do not guarantee that it will be uninterrupted or error-free, or that listings, applications or other content provided by users are accurate.

We do not guarantee that any property will be let, that any applicant will be approved, or that any party will meet their obligations under a lease.

14. Limitation of liability

To the extent the law allows, Hoadhaa is not liable for any indirect or consequential loss, or for any loss arising from a tenancy, a payment made between users, or the acts or omissions of another user. Nothing in these Terms limits liability that cannot be limited by law.

15. Governing law

These Terms are governed by the laws of the Republic of Maldives, and the courts of the Maldives have jurisdiction over any dispute about them.

16. Changes to these terms

We may update these Terms from time to time. When we make significant changes we will let you know in the app. The date at the top shows when they were last updated. Continuing to use Hoadhaa after a change means you accept the updated Terms.
